Welcome to the audeladespistes.fr website (the "website"), of Au-Delà Des Pistes, a non-profit association under the 1901 law. These Terms of Use apply to the consultation of the website, please read them carefully. If you do not agree to these Terms of Use, please do not register or use the website. By using the website, you agree to comply with these Terms of Use.

Description of services
Audeladespistes.fr is a website whose purpose is to promote the retaining of thoroughbred racehorses in France, by bringing to the attention of Internet users various information and facts in this field. The website provides information about the ADDP team, the charity's news and events, the process of retraining a racehorse at the end of its race career, the facilities accredited by ADDP, ADDP ambassadors and how to contact us. 

It is also possible to donate to ADDP by clicking on the link provided which will take you to the ADDP personalised page on the HelloAsso online donation website (a reliable and secure website). These donations will enable ADDP to achieve its main objectives: to promote the retraining of racehorses, to approve facilities for the retraining and taking in of former racehorses throughout France and to organise competitions in equestrian sports reserved solely for former racehorses.

Intellectual Property
All content or elements accessible on the website, in particular in the form of photographs or video clips (the "Content"), are protected by intellectual property rights and other private rights. All intellectual property rights and other proprietary rights relating to the drawings, texts, models, graphics, software and interfaces of the website are the property of ADDP. 

The Content also includes photographs or other items for which intellectual property rights may be held by third parties and for which we have obtained a right of use to exploit them on the website. 

You may not download, copy, store, modify, adapt or use the content for any purpose other than your own use of the website or as strictly described for the use of the services offered on the website. You agree not to adapt, alter or create any derivative material from the Content. You may not publish, distribute, sell or otherwise use the Content for any commercial purpose without the prior written consent of ADDP or in the event that the intellectual property rights in the Content are owned by a third party, with its prior written consent.

Use of the Website
This website is provided "as is". We do not guarantee that the Website or its Content is error-free, meets your needs, accurate, or up-to-date. You are fully responsible for your use of the website and any consequences that may result from the use of the Content. The website may contain links to other websites or social networks (Twitter, Facebook, Instagram, Youtube etc.), the latter being neither examined nor controlled by ADDP. We therefore decline any responsibility for the content of the sites to which we refer by means of hyperlinks.

We may at any time suspend, block or interrupt access to the website at our discretion.

Unless otherwise provided by law, you acknowledge that we are not liable for any loss and/or damage that you may suffer or incur while using the website.

Logo
The ADDP logo is the property of ADDP and has been licensed to us for the purposes of the website.

You may not use or adapt this logo on the website or imply that you are associated or linked in any way with this trademark.

Registration
By completing the registration form, you agree to provide real, accurate, up-to-date and complete information about yourself (such information being hereinafter referred to as "Registration Data"). You must inform us immediately of any changes to the information provided by updating it.

Responsibilities of the association towards the accredited structures mentioned
Accreditation does not imply any legal relationship between the charity Au-Delà Des Pistes and the accredited persons or entities, which are and remain legally independent of the association. The association may under no circumstances be held liable on any grounds whatsoever for the actions, initiatives or actions of accredited persons or entities.

General Terms and Conditions
We may update these Terms at any time, such changes will be notified to you when you visit the website.

Use of the website is governed by the version of the Terms of Use in effect on the day you access the website.

The Terms of Use of the website are subject to French law. Any dispute relating to their interpretation and/or execution shall be referred to the relevant French courts.

1. What data do we collect?

We collect data ("Personal Data") from you in different ways:

  • When you join our association, via our paper newsletters, or when you join or make an online donation via the HelloAsso/Audeladespistes website by clicking on the link in the "Support Us" section, we collect your contact details (e.g. name, first name, email address, telephone etc.). 
In this context, certain information marked with an asterisk (*) must be provided, if necessary if not we will not be able to register your membership or donation.

  • When you use our services on the website, through the use of "cookies" (see below), and 
  • Every time you send us emails.

2. Use of "cookies"

A "cookie" is a small block of data sent to your browser by our web server, allowing the server to collect information from your browser. We use "cookies" to identify Internet users when they visit the website, and in particular to produce statistics relating in particular to the number of visits, the number of pages viewed, the activity of website users and their frequency of return, via the audience measurement cookies of the Google Analytics tool.

We also inform you that all data collected through the use of these cookies will only be used by Au-Delà Des Pistes to compile statistics on site use, to the exclusion of any other use.

3. Our use of Personal Data

We use Personal Data about you for the following purposes:
 
1. To register and manage your membership or donations 
We use your Personal Data to administer our membership and donor file, including to provide you with your tax receipt.

The legal basis for this processing is the execution of the contract concluded with you concerning your membership of the association.

2. In order to send you information about our association, and our events via the Au-Delà Des Pistes Newsletter
The legal basis for this processing is our legitimate interest in providing our members, or persons who have requested it, with news about the association and its activities. You can decide at any time to no longer receive this information by clicking on the unsubscribe link in the emails sent to you, or by contacting us by email at: dataprotection@audeladespistes.fr

3. For statistical purposes

We may collect information that allows us to obtain statistics about visits to our website. 
The legal basis for this processing is our legitimate interest in being able to obtain information enabling us to better understand the use of our services in order to improve them.

4. Periods of storage of your Personal Data

We keep your Personal Data for the duration of your membership of the association, as well as for a period of three (3) years from the end of the association, or if applicable from your last contact with us.

In addition, We reserve the right to archive your Personal Data for the applicable limitation periods.

As far as audience measurement information collected on our site via cookies is concerned, we keep it for a period of five years.

5. Exercise of your rights 

In accordance with applicable law, you have the following rights:
  • The right to access your Personal Data, which allows you to request that we disclose all Personal Data about you that we process;
  • The right to rectify your Personal Data, which allows you to rectify, complete, or update Personal Data that is inaccurate, incomplete, ambiguous, or out of date;
  • The right to request the deletion of your Personal Data, in the cases provided for by the regulations (and in particular, when your Personal Data is no longer necessary for Us, when you object to the processing, when the processing is unlawful...);
  • The right to request the limitation of the processing of your Personal Data, i.e. to make your Personal Data temporarily inaccessible in order to limit its future processing, in the cases provided for by the regulations;
  • The right to the portability of your Personal Data, when the processing is based on the performance of a contract, i.e. to receive communication of the Personal Data you have provided to Us, in a structured and commonly used computer format; 
  • The right to object to the processing of your Personal Data for commercial prospecting purposes; and
